Scope

This notice applies to contracts concluded online by consumers through tennisgate.com. The rules concerning the start or expiry of the right of withdrawal depend on whether the purchased offer consists of digital content, a service or digital service, or a combination of these elements.

Where a purchase is processed by Paddle, Paddle is the authorised reseller and Merchant of Record for the transaction. The relevant Paddle entity is identified in the checkout and order confirmation. You may submit a withdrawal through the TennisGate withdrawal function below. TennisGate will document the request and, where required, coordinate or forward it to Paddle for implementation. You may also contact Paddle Buyer Support directly.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract is concluded.

To exercise the right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement, for example by a letter sent by post or by email:

For a transaction processed by Paddle, you may additionally send the statement to the Paddle entity named in your order confirmation or use Paddle Buyer Support.

You may use the model withdrawal form provided below, but this is not mandatory.

Electronic withdrawal function

You may also withdraw through the continuously available and prominently placed “Withdraw from contract” function on our website. It is accessible from the website footer. After entering the required information, submit the declaration using the “Confirm withdrawal” button.

You will receive an electronic acknowledgment without undue delay on a durable medium. The acknowledgment records the content of your declaration and the date and time on which it was submitted.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, all payments received from you in connection with the withdrawn contract must be reimbursed without undue delay and no later than fourteen days from the day on which the withdrawal notice is received.

The reimbursement will be made using the same means of payment used for the original transaction unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

Where the payment was processed by Paddle, the reimbursement is normally issued by Paddle as the authorised reseller and Merchant of Record. TennisGate may transmit the information required to identify the transaction and arrange the reimbursement. Processing times of banks or payment networks after the reimbursement has been issued may vary.

Proportionate payment for services started during the withdrawal period

If you expressly requested that the performance of a service begin during the withdrawal period and you subsequently withdraw, you must pay a reasonable amount corresponding to the proportion of the services already provided up to the time when you informed us of the withdrawal, compared with the full scope of the contract. This applies only where the statutory requirements for proportionate payment have been met.

Early expiry for digital content

For a contract for the supply of digital content that is not supplied on a tangible medium, the right of withdrawal expires before the end of the fourteen-day period only where all of the following conditions are met:

  • performance of the contract has begun;
  • you expressly consented to performance beginning before the end of the withdrawal period;
  • you acknowledged that, by giving that consent, you lose your right of withdrawal when performance begins; and
  • you received the legally required contract confirmation on a durable medium recording your consent and acknowledgment.

This may apply in particular to immediately activated pre-produced videos, video categories, recordings and self-paced courses where the relevant contract consists exclusively, or in a separable part, of the supply of such digital content.

Expiry for services and digital services

For a paid service or digital service, the right of withdrawal generally expires only when the service has been fully performed, provided that you expressly consented before performance began to performance starting before the end of the withdrawal period and acknowledged that the right of withdrawal would expire upon full performance.

This may apply to live webinars, personal support, consulting or coaching and other services that are not fully performed merely by activating access. Until full performance, withdrawal generally remains possible; where you properly requested an early start, proportionate payment may be due for the part already performed.

Memberships and combined offers

Memberships and combined offers may contain both immediately supplied digital content and continuing digital services. The legal effect of a withdrawal is determined separately according to the actual components of the offer. The right relating to an identifiable supply of digital content may expire when supply begins if all statutory conditions are met. A right relating to a continuing service does not expire merely because access has been activated and generally expires only upon full performance under the statutory conditions.

Cancelling automatic renewal is different from exercising the statutory right of withdrawal. Cancellation normally prevents future renewal and leaves access in place until the end of the paid period. A valid withdrawal reverses the relevant newly concluded contract in accordance with the statutory rules.
